§ 8.32.150. Enjoining of detonation by city.

Latest version.
  • A.

Because of the inherently dangerous chemical nature of high explosives and the incalculable and omnipotent danger to lives and property from the intemperate and unregulated use of high explosives in an urban structure, the city shall and does now have the right to enjoin any further detonation of high explosives within its corporate limits when any part or all of this chapter is violated on a periodic or essentially continuous basis.

    B.

For the reasons expressed in subsection A of this section, the city shall likewise have the right to enjoin any such imminent detonation of high explosives within its corporate limits whenever such explosion would in all reasonable probability release into waterways debris or emit into the atmosphere pollutants in the form of dirt, dust, sand, rock or particles thereof.
